6 years in prison required against Éric Lammers, prosecuted for several acts of morals

The public prosecutor requested Monday afternoon before the Charleroi Criminal Court a sentence of 6 years in prison with a provision of the TAP for 5 years against Éric Lammers.

The 61-year-old man, detained in Leuze-en-Hainaut prison, is being prosecuted for rape of an 11-year-old girl suffering from mental retardation and indecent assault on this same victim and on the sister of this last and for the possession of child pornography images. A 5-year prison sentence was requested against Maurice Lammers, the defendant’s father, prosecuted for indecent assault on one of the two victims, possession of child pornography files and incitement to debauchery on two minors. Both defendants dispute the charges.

On March 19, 2020, the young victim, aged 11 and suffering from mental retardation, confided during a meal at her dad’s home to have been touched by Maurice Lammers. “The day after this denunciation, the father contacted the youth aid service. This is the beginning of the file. The victim confirms that the defendant is her lover,” said the public prosecutor. Maurice Lammers, 86, denies having committed indecent assaults on the latter, having held 39 child pornography photos on his computer and having incited two minors to debauchery. “I know nothing of these photos which are not mine. I have never taken any sexual pleasure from contact with a child. I looked at her completely naked during a bath, and I wiped her off. I went into the bath in my underpants to retrieve the victim and I wiped him off,” confirmed Maurice Lammers.

Éric Lammers was arrested and detained in Serbia on October 7, 2020 on the basis of an arrest warrant issued by a Carolo investigating judge. After several months of detention in a Serbian prison, Éric Lammers arrived in Belgium last February. The latter is being prosecuted for the rape of the 11-year-old victim and indecent assaults on the same victim and on the latter’s 8-year-old sister, and for the possession of child pornography images showing sexual abuse of the first victim. According to the statement provided by Maurice Lammers, the photos were taken in Eric Lammers’ bedroom. The defendant disputes the charges against him, and this since the beginning of the investigation.

The public prosecutor has requested a 5-year prison sentence against Maurice Lammers, known to justice since 1985 and considered “a dangerous character”, according to the deputy prosecutor. A sentence of 6 years in prison, with a provision to the court for the application of sentences of 5 years, is requested against Éric Lammers. The latter has already been sentenced to life in 1991 by the Antwerp Assize Court for the murder of two Antwerp jewelers. He was also convicted in 2004 by the Liège Court of Appeal for concealment of corpses and in 2007 for child pornography. In 2012, he was also acquitted by the criminal court of Liège concerning acts of morals committed on a child of his entourage. Éric Lammers is also known to have been questioned several times in the case of the Brabant killers, a criminal organization which caused the death of 28 people in Belgium between 1982 and 1985, during several robberies. “There have already been identical facts. He does not cooperate, not to mention the risk of going abroad where he still has roots in Serbia. He’s a dangerous character.”

Me Lepied, in defense of Maurice Lammers, pleaded an acquittal for the four charges contested by his client. “There is no history of morals, I do not see him starting this type of facts right now. If the young girl saw things and adopted deviant behavior, it was long before all that, it dates back to 2018. Me Laquay, defending Éric Lammers, also pleaded an acquittal for all the charges. “What most incriminates the defendant is this hearing of the victim, which we do not consider at all credible. She never describes the abusive scenes allegedly committed by Eric Lammers. We cannot say that he committed the rape.”
