The Sixth Section of the Provincial Court of A Coruña, based in Santiago, has sentenced a man to two and a half years in prison for four crimes of mistreatment of work in the domestic sphere for punishing his daughter, a minor, with cold showers and beatings with a belt. The sentence, issued in December 2021 and reported by Europa Press, confirms a previous ruling by the Criminal Court number two of the Galician capital.
The man was convicted as the author of four crimes of mistreatment of work in the domestic sphere to sentences, for each of them, of seven months and 15 days in prison. In addition, the court has prohibited him from approaching less than 200 meters from his daughter, her home, her place of study or work or anywhere where she is and from communicating with her by any means for a period of one year, seven months and 15 days, as well as the payment of four-fifths of the procedural costs. He has been acquitted, on the contrary, of a crime of habitual mistreatment.
In the account of proven facts, the ruling of the Provincial Court states that “those of the appealed judgment are accepted.” The man, he indicates, had sole custody of her daughter, born in 2004, since around 2006 he moved with her to live in Spain. The mother of the minor then remained in Ecuador. For work reasons, they lived in different cities of the Spanish geography and since approximately 2010 they lived with the new wife of the father, in whose care the girl often remained, since the father was frequently absent due to work.
The sentence qualifies the educational style of the condemned as “rigorous and authoritarian” and points out that it came, especially when the man consumed alcohol, to be aggressive both with her and with his second wife. This behavior caused the minor mental health problems and a depressive disorder “of significant clinical entity”, according to the resolution. One of the punishments that the defendant applied to her daughter if she considered that she “had done something wrong” was to force her to get into the shower with cold water and beat her on the legs and buttocks with the belt strap. She did so on at least two occasions when they lived in Madrid and the youngest was 10 or 11 years old.
On another occasion, the minor was seven minutes late from the time that the defendant had set for her to return home after going out with her friends, and when her father arrived he told her that “she was going to receive seven belts for the seven minutes of delay and began hitting her on the legs with the belt,” the ruling said. In 2017 the defendant “hit the minor with the belt once again for the bad grades she had taken,” he adds.
One of the elements on which the sentence is based is the intervention of the social assistance teams of the City Council and the Xunta, which led to declaring the minor in a situation of abandonment and that her legal guardianship passed to the Xunta.
