The speeding drive on August 19, 2017 was filmed by the driver’s cousin, who was sitting in the back seat of the vehicle. The video, which lasted around two minutes, was then posted on a social media platform, according to the judgment of the Federal Supreme Court published on Monday.
The video proves that the speeder exceeded the urban speed limit of 50 km/h by 65 km/h. He also exceeded the signaled speed of 60 km/h by 50 km/h. Out of town he drove at 214 km/h instead of a maximum of 80 km/h.
He also overtook a vehicle in town at a speed of 80 to 100 km/h despite oncoming traffic. And the then 34-year-old Turk was not wearing a seat belt and did not have his vehicle registration document with him.
The Supreme Court of the Canton of Solothurn sentenced the speeder to 36 months in prison for a qualified gross violation of traffic regulations. In contrast to the district court in Olten-Gösgen, the higher court pronounced the expulsion from the state of seven years requested by the public prosecutor’s office.
The Swiss-born Turk wanted to obtain a conditional prison sentence by filing a complaint with the Federal Supreme Court. The country expulsion should also be avoided. The Lausanne judges rejected the complaint – and confirmed the judgment of the Supreme Court.
The culpability of the man is moderate or severe, according to the considerations of the Federal Supreme Court. The man’s delicacy goes back to his youth.
The country expulsion is not objectionable. The man is fluent in the Turkish language. He had not succeeded in gaining a proper foothold in Switzerland, both economically and professionally. He lives on half an IV pension, is single and has no children.
There is also a risk to public safety. In its judgment, the Federal Supreme Court referred to the man’s criminal record and other road traffic offences. There is still a character-driven tendency to boast about massive speeding. (Judgement 6B_429/2021 of May 23, 2022)
