“Chicken case”: Supreme Court reverses TDLC decision and declares class action admissible – National

The Third Chamber of the Supreme Court resolved this Wednesday, January 13 reverse a ruling of the Court for the Defense of Free Competition that declared inadmissible a class action lawsuit following the call “collusion of chickens” occurred in 2014 and that involved the companies Don Pollo, Ariztía and Agrosuper.

After analyzing the case the Supreme Court reversed the TLDC ruling and declared admissible the legal action that was filed by a large number of clients in conjunction with the National Corporation of Consumers and Users (Conadecus) after the mentioned companies incurred behaviors anti-competitive such as assigning quotas in the market and limiting chicken production in order to generate an increase in the price of its meat.
