The seven plaintiffs claimed that Mr. Liu did not leave a bequest and support agreement or will during his lifetime, and he had no first or second legal heir when he died. According to the relevant regulations, the entire legacy of Uncle Liu can be shared. The defendant, Ms. Zhu, did not say much, and requested the court to make a judgment in accordance with the law.
When the Civil Code comes into effect on January 1, 2021, the case is still under trial. The “Civil Code” newly added a “nephew and nephew succession by subrogation” system. The plaintiff then changed the petition, requesting the court to divide Mr. Liu’s real estate in accordance with the provisions of the “Civil Code” on the succession of nephews and nephews by subrogation.
After mediation presided over by the judge, the two parties reached a mediation agreement in court. The real estate involved in the case is shared by two of the seven plaintiffs, that is, Mr. Liu’s nephew and niece. At the same time, the two paid a total of 400,000 yuan in discount for Ms. Zhu’s inheritance share. . As for the estate distribution among the seven plaintiffs, they shall properly resolve it by themselves according to the internal negotiation plan.
