From the next year onwards, victims of traffic accidents must also cover their own negligence through their own insurance. Currently, the insurance company of the other party pays the full premium regardless of the degree of negligence. In order to block ‘Nylon patients’ who receive excessive settlement money while receiving treatment for longer than necessary, it is mandatory to submit a medical certificate when receiving hospital treatment for more than 4 weeks due to a traffic accident.

The Ministry of Land, Infrastructure and Transport, the Financial Services Commission, the Financial Supervisory Service, and the Health Insurance Review and Assessment Service announced on the 30th a plan to improve the auto insurance system with the same contents. This is in response to an increase in the burden of insurance premiums on the people due to the recent surge in auto insurance payments.

According to the improvement plan, for accidents that occur from 2023, patients with minor injuries (grades 12 to 14) must be responsible for their own negligence part of the treatment costs with their own insurance (self-injury compensation, auto-injury special contract). Currently, the insurance company of the vehicle involved in the accident bears all the medical expenses, so the driver with greater negligence received more compensation, and the driver with less negligence paid a larger amount.

For example, when A and B vehicles have a traffic accident with a negligence ratio of 30 to 70, the driver of vehicle A does not receive treatment, and the driver of vehicle B (grade 14 injury) receives 1 million won in medical expenses and other damages (alimony, etc.) 150 If 10,000 won came out, now the insurance company of car A has to pay the entire medical expenses of the driver of car B of 1 million won. However, starting in 2023, one person will have to pay 500,000 won for treatment and 150,000 won, which is 30% of the remaining 500,000 won, to pay 650,000 won. In order to guarantee the right to prompt treatment, as now, the other party’s insurance company pays the cost of treatment, and then it is settled by recovering the part of the person’s negligence.

With the introduction of the principle of negligence for ordinary patients, the government expects to reduce excess treatment by 540 billion won per year. This is the effect of reducing insurance premiums per person by 20,000 to 30,000 won.

The amendment also included the requirement that patients with minor injuries be required to submit a medical certificate for long-term hospital treatment. Coverage is available without a medical certificate for up to 4 weeks, and a medical certificate is required from 4 weeks or more.

Standards for payment of insurance benefits for emergency rooms will also be specified. Currently, the insurance pays the entire hospitalization fee regardless of the room grade, but plans to apply the upper limit on the upper-level room admission fee as early as next year. A plan to improve the standard for the number of treatments in the field of oriental medicine such as herbal medicine and acupuncture will also be prepared.

When a spouse with accident-free driving experience who has subscribed to the special contract for married couples purchases separate insurance, the accident-free period of up to three years will be recognized equally. In addition, if you sign up for a special marital contract under your spouse’s name, the problem that the accident-free period is not recognized when you purchase insurance under your own name will be improved. From next year, even if the insurance is purchased separately, the accident-free period of up to three years is recognized as the same, and premiums are expected to be reduced by 20-30% compared to the previous year.
