Mini victory for child in court

First victory for Hanover boss Martin Kind (78)!

The district court in Hanover gave him back his job as managing director on Tuesday at 2 p.m. On July 28, Kind was fired by the eV board of directors headed by Sebastian Kramer “for important reasons”.. The child fought back.

But – it’s just a mini-victory for now. An appeal by the other side to the Higher Regional Court in Celle is likely. In addition, there is still a main matter procedure to be followed – but this has not yet been scheduled.

Kind did not appear in court in person, remaining in his office at 96 Arena during the trial. In between, he relaxed and brought documents to his car, taking selfies with fans in a good mood. Before the verdict was announced, he got into his car at 1:52 p.m. and drove away.

His lawyers argued to Chairman Carsten Peter Schulze that Kind’s ouster was void because it was not carried out by the Board of Directors as provided for in the Articles of Association.

In addition, due to a stalemate situation in Management GmbH, no successor could be found for him – so he had to remain in office. A strange approach…

The eV – represented in court by the boss of the supervisory board, Ralf Nestler – repeated his allegations that Kind had constantly not followed instructions and that throwing him out was therefore legal. Among other things, Kind had not had the contract with new coach Stefan Leitl approved, although he should have done so because of the salary volume of over 100,000 euros per year.
