The sprinkler watered. The owner of an apartment in the 16th arrondissement of Paris sued his tenant for non-payment of rent. Indeed, the latter had stopped, on her own initiative, to pay her the 350 euros per month to occupy the furnished room. The reason ? A size deemed “indecent”, as Le Figaro points out.

The case is therefore handled by the Paris court which orders the tenant to pay 10,800 euros for non-payment of rent for 18 months (from December 1, 2020 to May 1, 2022, date of the judgment). If, as the court reminds us, “compensation for a disturbance of enjoyment does not reciprocally exempt the tenant from his obligation to pay the rent”, renting indecent accommodation is also prohibited.

Bad surprise therefore for the owner who was also ordered to pay 10,800 to his tenant. Indeed, the “apartment” had a floor area of ​​6.89 m² and a living area of ​​4.24 m², far from the minimum 9m² for decent housing. This was therefore considered as “the lessor’s breach causes the tenant a disturbance of enjoyment which justifies compensating him from May 1, 2017 and until May 2022, date of the judgment, in the amount of €177.04. per month, i.e. a total sum of 10,799.44 euros”
