The protest on Alito’s doorstep was the latest round of action by abortion supporters against the Supreme Court. Liberals protested and demonstrated across the country last week after the Supreme Court’s draft opinion to overturn Roe v. Wade was leaked, and the Supreme Court was forced to erect a fence to protect it from shock. But tensions continued to escalate, and starting over the weekend, protesters took action to the private mansion of the justices, Chief Justice John Roberts and conservative Justice Brett Kavanaugh. It was unclear whether Alito, who wrote the draft opinion, was at home Monday night, arguing for Roe v. Wade to be overturned. Ahead of Monday night’s protests, Alito canceled a planned appearance in Nashville, Tennessee, where some unconfirmed reports suggested he may have gone into hiding for the time being.

Demonstrations outside the justices’ residence angered conservatives. On Monday, Senate Minority Leader Mitch McConnell condemned the moves, while warning that federal law criminalizes demonstrations intended to influence a judge’s ruling.

The Senate also unanimously passed a bipartisan bill Monday night to provide security for immediate family members of the justices.

The Biden administration has tried to balance condemnation of violence and support for abortion, with White House press secretary Jen Psaki on Monday condemning threats or violence, but not the protests at the justice’s doorstep.

“We are a democracy-promoting country, and we certainly allow peaceful protests in a range of places in the country,” Psaki said, adding that “none of this should be against the law.”

According to The Hill, some political analysts saw the response as tepid. Russell Wheeler, a visiting scholar at the Governance Studies Program at the Brookings Institution think tank, believes a Biden administration could have sent a stronger message.

“It’s clear they’re trying to tread carefully between taking a firm stance against violence against judges and not alienating their grassroots who support Luo’s case,” Wheeler said.
