The digital influencer Daniel Augusto Bicalho Ferreira de Souzaknown as MC Dugaoo, was sentenced to four years and one month in prison open regime for selling fake iPhones made from clay.

The decision was handed down by the 4th Criminal Court of Belo Horizonte and was motivated by the complaint of a couple who purchased the “devices” after negotiating through a sales website. We even talked about this case last April.

According to the judge’s ruling Vítor Marcos de Almeida SilvaMC Dugaoo used his popularity and credibility on social media — on which he accumulated more than 300 thousand followers — to gain the trust of victims and facilitate the scam.

He allegedly arranged a meeting with the couple in the Camargos neighborhood, in Belo Horizonte, and upon delivering the sealed package, threatened the victims, claiming to be armed and demanding the transfer of R$13,000 via Pix.

Frightened by the threat that the influencer was armed, the couple made the payment. After he left the place, they opened the package and discovered that, instead of the promised cell phones, there were clay bars to imitate the devices.

According to the conditions of the open regime, MC Dugaoo will be able to work and study during the day, but must retire at night and on days off. He was also forced to refund the amount of R$13,000 to the couple.

The Influencer Advocacy declared to g1 who will appeal the decision, stating that no compelling evidence was presented about the threat, claiming that the accused did not carry weapons. The defense also argued that security camera images show that the negotiation was peaceful.
