The Commission for the Control of Unfair Competition of Indecopi imposed a precautionary measure this Thursday and ordered Latina Televisión to immediately and preventively stop broadcasting all advertisements related to the Qatar 2022 World Cup.

The commission made this decision unanimously, taking into account that the World Cup is taking place and that consumers would continue to see their expectations disappointed, by not being able to watch certain matches live, despite the campaign deployed by the television house.

The measure adds to the initiation of a sanctioning administrative procedure against Latina, for having disseminated misleading , which would imply that it would transmit “live” all the matches of Qatar 2022, either through its open signal channel or through its application, when this would not be true, since half of the matches would be broadcast deferred through its application.

In addition, that the channel would be the only means of communication that would officially transmit the matches of said sporting event, when this would not be true, since there would be a satellite television communication medium that with a digital application would also officially transmit the matches of the aforementioned contest. .

It should be noted that Latina is within the legal term to formulate its defenses, as well as to present its appeal against the precautionary measure before the Indecopi’s Specialized Chamber for the Defense of Competition, the last administrative instance of the Institution.

How much would the fine be for Latina?

Likewise, it is necessary to point out that, if the spread of alleged misleading by Latina is corroborated, the Commission is empowered to impose a penalty of up to 700 UIT (tax tax units), equivalent to S/ 3’220,000.

Indecopi announces this decision under article 39 of the Law for the Repression of Unfair Competition, which specifies that “(…) the Technical Secretariat is empowered to inform the public, in an objective and explanatory manner, about the pronouncements issued by the Commission, without prejudice to the fact that they are within the period to be challenged or have been the subject of any appeal.”

In addition to that, “of administrative procedures or investigations in progress, provided that said acts have social relevance or that they serve to prevent the facts subject to investigation or pronouncement from negatively affecting consumers or other economic agents.”
