SNCF 1-Famille Mulliez 0. The Paris commercial court rendered its decision on Friday September 22, favorably accepting the request from SNCF Gares & Connexions. The latter demanded 47 million euros from the northern family in charge for a time of renovating the Gare du Nord in Paris via its company Ceetrus and also owner of Auchan, Leroy Merlin, Decathlon… The railway company demanded this sum under the “first demand guarantee”.
Quesaco? In the present case, it is a contractual mechanism by which SNCF Gares & Connexions could ask Ceetrus for up to 78 million upon simple request and without justification. Even if the contract between the two entities has been broken, and their common project will never see the light…
