Currently, in the vast majority of cases, only one of the two parents is identified as such and can therefore benefit from the support measures intended for single-parent families, such as housing aid or additional pay for parental leave.

According to the “Parents Barometer” published by the League, 28% of separated couples share the accommodation of their children and, among them, 51% organize themselves amicably. According to the League, Belgian legislation does not sufficiently take this scenario into account and therefore leaves many single-parent families on the sidelines.

Indeed, to benefit from the assistance to which they are entitled, the latter must have their children domiciled at home, receive family allowances or have their children dependent for tax purposes. However, this is often the case for only one of the two parents. The situation is slightly easier when a judgment defines the terms of joint custody, but this judicial decision is nevertheless not taken into account by all the organizations.

Faced with this observation, the association proposes the establishment of a “register of accommodation arrangements”. This would record all alternating guards, amicably or defined by a court decision. The administrations granting aid could therefore consult the register and allocate aid to parents who have their child at least 25% of the time.

The League specifies, however, that there is no question of dividing the amount of this aid between the parents in proportion to the time of custody. Each would receive the full amount of the various support measures.
