A judge in Córdoba rejected an injunction from the Rural Society for not paying withholdings
The Federal Justice of Córdoba rejected an injunction from the Rural Society of Río Cuarto against the collection of export duties. From the local agricultural entity they considered that the retentions were illegal for not having a Budget law that supports it.
The measure was adopted by the federal judge of Río Cuarto, Carlos Arturo Ochoa, who rejected the presentation of the Rural Society where they demanded the declaration of unconstitutionality and illegitimacy of the collection of the tax as of January 1, 2022.
The ruling also rejected any regulatory provision in which it is intended to support that tax claim.
The claim of rural employers
The Rural Society of Córdoba considered that, since January 1, the withholdings were no longer applicable, because Congress did not approve the extension of the law linked to the economic emergency of 2019 by rejecting the Budget 2022.
The federal judge considered that the requirements to process the case as a collective process were not present in the case.
It did so because the Rural Society of Río Cuarto does not have standing to support the legal claim.
