However, Sánchez Cordero, who was Minister of the Supreme Court of Justice of the Nation (SCJN), told her that this was impossible, because “the pardon proceeds when there are final sentences, at this time all sentences are non-existent due to the replacement of the procedure ”.

“There are no sentences, the pardon proceeds only with final sentences,” confirmed the Secretary.

Rafael’s mother, Judith Valenzuela, stated that her son was accused in January 2008 of organized crime and carrying arms in Valle de Bravo, but not for bringing drugs, as Secretary Sánchez Cordero had mentioned.

“A precision for the Secretary is that they did arrest him and accused him of organized crime, weapons, and you said that for bringing drugs and no, it was not like that, there was no drug,” he clarified.

Despite the fact that the young man has obtained four protocols from Istanbul, where it was found that he was tortured, he is still in prison, even the young man’s mother stated that the United Nations (UN) itself had already requested his release.

“The Human Rights Committee of the United Nations (UN) asked the Mexican Government to release my son and repair the damage,” he said.

“I just want you, or those who are there to answer me, why my son, who is 13 years in prison for an unjust conviction, and who three years ago should have been free with me, with his family at liberty, why is he still prisoner? ”, he remarked.

This prompted President AMLO to reply that this case is intended to “know if the attitude of the judges is in accordance with the law and if they acted with justice.”

“He is a young man who is arrested, he is serving his sentence, however, in one of the processes, a judge decides that the procedure should be reinstated, so instead of releasing him because he has already served his sentence, they keep him imprisoned because there is a sentence that mandates that the process be reinstated and the investigation is to be restarted, with all the delay that characterizes the Judicial Power and in fact those who should be free are in jail, if justice is put before it . If the law is put forward, we have to wait for the procedure to be restored ”, declared the president.


Despite the fact that Sánchez Cordero told the President that he could not pardon Rafael, he assured that under the Istanbul protocols, a judge could grant him his freedom immediately.

“I believe that on the subject of torture, President, a sensitive judge would grant you freedom immediately. With the Istanbul protocols I would grant it immediately ”.

With this, the President promised to resolve the situation, and said that a complaint will be filed with the Council of the Judiciary to see if an amnesty can be granted in the case, he also promised to speak today with the President of the Supreme Court. “Being respectful of the independence of the Judiciary, we are going to present this complaint so that the body in charge of administering judges and ministers, the Council of the Judiciary, does what corresponds, and hopefully they can resolve it soon … or that they recommend us if we like Members of the Executive Branch could declare an amnesty in this case. I trust the Federal Judicial Council because fortunately its members are people with a social dimension, the same judges and magistrates and ministers, there are sensitive men and women.
