TOU.TV EXTRA: the CRTC rejects Quebecor’s complaint

In a decision released on Tuesday, the CRTC considers that by offering its paid subscription video-on-demand service, ICI TOU.TV EXTRA, free of charge to TELUS customers, the Société Radio-Canada is not giving itself any undue preference and is not granting such preferences to TELUS Communications inc.

In his complaint filed on October 30, 2019 on behalf of Videotron, the President and CEO of Quebecor, Pierre Karl Péladeau, argued that the paid subscription service offered by the TOU.TV EXTRA platform violated the rule on exclusivity of programming offers by entering into an agreement which only allows TELUS subscribers in Quebec to receive TOU.TV EXTRA free of charge.

He also believed that the agreement with TELUS guaranteed to SRC a pool of millions of subscribers and thus created unfair competition for broadcasting distribution companies (EDR) existing.

However, the Board noted that Rogers has already availed itself of such an agreement and that the SRC claimed to have already presented it to Videotron.

In addition, the CRTC considers that TOU.TV EXTRA does not have the characteristics of a EDR traditional and therefore does not have the obligation to offer a basic package or to contribute to Canadian programming in the same way as a EDR.

Rather, the Commission considers the video-on-demand service ICI TOU.TV EXTRA to be a broadcasting programming undertaking that transmits programs only over the Internet, such as Netflix or Club illico.
