Members of the Justice Commission of the Convention described the declaration of the Supreme Court as an “undue interference” in which concern was expressed about the limit on the duration of the positions of magistrates.

All this after it was stated -by means of a statement- written by the highest court, that there is an alert Regarding an initiative that seeks to limit the duration of judges both from the Supreme Court as well as from the Court of Appeals and of first instance.

In this line, the minister Ángela Vivanco exposed the objections of the highest court, pointing out that the principles of independence and irremovability must be defended.


Limit duration of judges

“A judge has to be appointed without any time limitation”, this is one of the phrases reflected in the statement issued this Tuesday by the highest court.

The entity showed its annoyance and concern about a rule approved in general by the Justice Commission.

Among the aspects contained in this proposal is the limit on the term of office of the magistrates of the Supreme Court.

It is worth mentioning that the judges have a duration of up to 75 years.

The norm -promoted by sectors in the Convention- seeks to limit the above, and establish that each magistrate or minister can hold this position for up to a maximum of 15 years in the case of the Supreme Court.

In the case of the Court of Appeals, that this remains in a limit of eight years.

“Undue interference”

The coordinator of the Justice Commission, Christian Viera, stated that the rule was recently approved in general, so it is still missing for the vote in particular.

The independent convention, Mauricio Daza, pointed out that there has been no body -that as such- has gone so far and said that this is “an attack on the autonomy of the Constitutional Convention, which must be respected.”

Likewise, the constituent Manuela Royo (MSC), criticized that “this is an undue interference by the Supreme Court and we consider that this interference is worrying, regarding the independence and autonomy of the Constitutional Convention.”

Meanwhile, Hugo Gutiérrez, a member of the Communist Party, maintained that “they attack that freedom to seek a Power of attorney that is in accordance with popular demands.

The conventional socialist and deputy vice-president, Tomás Laibe, also referred to this situation, pointing out that “the Constitutional Convention is autonomous”.

All this after the rule approved in general by the Justice Commission of the Constitutional Convention, which seeks to limit the duration of judges.
