Italian Police Officer’s Suspension Over TikTok Kick Reversed by Court

A State Police officer in Calabria, Italy, has been reinstated to full duty after a regional administrative court overturned his suspension. The officer had been suspended in May 2023 following a video circulating on TikTok that showed him kicking a man during an arrest in April 2022. The court ruled the suspension was issued without proper due process, specifically without allowing the officer an opportunity to present his side of the story.

The case stems from an incident on April 2, 2022, near the Zaccheria stadium in Foggia, where the officer, then serving with the ‘Northern Calabria’ Crime Prevention Department, was part of a patrol that attempted a traffic stop. According to reports, the driver of the vehicle attempted to evade the officers, leading to a chase. The two occupants were subsequently arrested after being found in possession of drugs.

Shortly after the arrest, a video surfaced on TikTok showing the officer kicking the face of one of the arrested men at the Ex Onpi building in Corso del Mezzogiorno. The video quickly gained attention, prompting a criminal investigation and the officer’s reassignment to non-operational duties. More than a year later, in May 2023, the Ministry of the Interior issued the precautionary suspension, reducing the officer’s salary to half pay.

Represented by lawyers Giuseppe Carratelli and Santo Infusino, the officer appealed the suspension to the Calabria Regional Administrative Court (TAR). The appeal argued the suspension lacked justification, failed to consider the impact on the officer’s career, and crucially, was issued without providing him a chance to respond to the allegations. The TAR agreed, stating that a precautionary measure of this kind “requires a prior discussion with the party to whom the measure is addressed.”

Court Cites Procedural Errors in Suspension

The court’s decision also acknowledged a dismissal order issued by a judge in Foggia in October 2024 regarding some of the charges related to the incident. While details of those charges are not immediately available, the dismissal order factored into the TAR’s ruling. The court’s sentence is immediately enforceable, meaning the officer is now eligible to return to full service with full pay.

This case highlights the increasing scrutiny of police actions captured on social media, particularly TikTok, and the legal challenges that arise when such videos become public. The platform has become a significant space for documenting and sharing encounters with law enforcement, often sparking debate and calls for accountability. Calabria itself has seen increased attention on TikTok as a travel destination, but this case demonstrates a different side of the region.

The incident also echoes broader concerns about police conduct and the use of body cameras. The reinstatement of the officer in Calabria underscores the importance of due process and the need for thorough investigation before disciplinary action is taken, even in cases where video evidence appears damning. The court’s decision serves as a reminder that procedural fairness is a critical component of the justice system.
