After 34 years, the Supreme Court of Pakistan granted the right of inheritance to the niece from the maternal uncle. The court ordered the Dera Ghazi Khan Department of Finance to give immediate possession of 5 square meters of land to Sara Akhtar and also ordered the uncle Sardar Mansoor to pay all legal expenses to the niece.

A case against Bhanji was heard in the Supreme Court on the request of a person named Sardar Mansoor. A 3-member bench headed by Chief Justice Fayzaisi heard the petition.

The petitioner’s counsel submitted to the court that the niece (Sarah Akhtar) sold her land to her maternal uncle Sardar Mansoor in 1989, but after 20 years she claimed ownership of the land and denied her own signature.

Justice Aminuddin Khan remarked that it was the buyer’s job to prove the purchase of the land.

Yasin Bhatti, the lawyer of niece Sara Akhtar, appeared in the court and submitted that Sara Akhtar was a minor at the time of the alleged sale of the land, while Sara’s uncle Sardar Mansoor is the former chairman of the district council. , transferred to the names of wife, mother-in-law and brother-in-law.

Speaking to the lawyer of the petitioner, Sardar Mansoor, the Chief Justice said that women’s rights are being violated in an unconstitutional and illegal manner, so the land should be handed over to Bhanji.

While talking to Chief Justice Faiz Isa, the lawyer said that whatever the court says women will be considered correct. On which the Chief Justice remarked that no special concession is being given to women, he has given the same observation which is unfortunately happening in the society.

The petitioner’s lawyer said that it is not always necessary for a man to violate the right of a woman. On which the Chief Justice remarked that there has not been any case in which a woman has violated the right of a man.

The court ordered the Finance Department DG Khan to provide immediate possession of the five square plot of land to the niece Sara Akhtar and also directed the uncle to pay all the litigation expenses to the niece.
