“Former President of Georgia Mikheil Saakashvili’s Treatment Lawsuit Denied by ECHR: Updates and Details”

The European Court of Human Rights (ECHR) did not satisfy the lawsuit of the lawyers of the former President of Georgia Mikheil Saakashvili demanding to defer punishment for their client and transfer him to a Warsaw clinic for treatment, said the head of the Georgian Ministry of Justice, Rati Bregadze. Now the ex-president convicted in Georgia is being treated at the Vivamed clinic in Tbilisi.

“Today, the decision of the Strasbourg court was published, according to which, in the case of the convicted Mikheil Saakashvili “Saakashvili v. Georgia”, his transfer to Warsaw was denied,” said Mr. Bregadze (quoted from “Interfax”).

The head of the Ministry of Justice of Georgia clarified that the decision of the ECHR does not oblige Georgia to transfer Mr. Saakashvili for treatment to any other medical institution within the country.

According to Mr. Bregadze, the transfer of the ex-president of Georgia from the Vivamed clinic back to prison will be carried out if the doctors allow it. “At this stage, there are no objective prerequisites for his transfer either to another clinic or to a penitentiary institution. Accordingly, he continues to be treated at the Vivamed clinic,” the minister stressed.

Lawyers for Mr. Saakashvili filed a lawsuit with the ECtHR for a suspension of imprisonment on 11 April. The suit is accompanied by a conclusion of a council of doctors, according to which Mr. Saakashvili has a number of endocrinological and mental diseases and needs urgent treatment. According to the council, the treatment course that the former president is currently undergoing at the elite Vivamed clinic in Tbilisi is not enough for recovery.

Mikheil Saakashvili, who led Georgia from 2004 to 2013, was sentenced in absentia by a Tbilisi court to six years in prison in 2018 for orchestrating the 2005 beating of opposition MP and businessman Valery Gelashvili by Interior Ministry special forces.

The ex-president secretly returned to Georgia from Ukraine on the night of September 29, 2021, a few days later he was arrested. On March 5 this year, the politician reported a significant deterioration in his health for a year and a half spent in custody in Georgia.
