How Company Car Drivers Can Avoid Paying Fines: Revealing the Loophole and Proposed Solutions

2023-09-12 07:59:00

It is regarding this phenomenon that our colleagues from Nieuwsblad alerted this Tuesday morning. Indeed, they argue that motorists who drive in company cars can avoid paying their fine.

But how does this happen? To be able to grant the fine, a municipal administrative sanction, to the offending motorist, the municipality needs to know the name of the driver. However, companies that offer company cars to their employees do not always provide the names of those who drive them.

As revealed by our colleagues, the Flemish Mobility Council declared in its opinion to the Flemish Parliament that “the refusal to notify the indisputable driver generally results in the fine procedure being stopped”.

However, a solution exists to counter this phenomenon. The Department of Justice must force owners to declare the driver of the vehicle.

The Flemish Association of Cities and Municipalities has asked the Flemish Minister of Mobility, Lydia Peeters, to “rapidly tackle this known problem”.
