With the decision of December 14th (G 352/2021), the Constitutional Court partially repealed two paragraphs of the Code of Criminal Procedure that focus on the so-called confiscation of cell phones. According to the Constitutional Court, the seizure of cell phones and mobile data carriers in criminal proceedings without prior judicial authorization is unconstitutional.
