Minister of the Supreme Court proposes to eliminate the ban on public servants from working in IP for 10 years

The Minister of the Supreme Court of Justice of the Nation (SCJN) Norma Lucia Pina Hernandez He will propose to his colleagues in plenary to eliminate the prohibition that prevents former public servants from working for private companies following leaving office for a period of ten years.

This prohibition is found in the Republican Austerity Law promoted by the government of Andrew Manuel Lopez Obrador which was challenged since 2019 by opposition senators.

“The challenged rule disproportionately restricts freedom of work, since the 10-year duration of the ban on working in private companies that former officials have regulated, supervised or in respect of which they have had privileged information, goes beyond what is reasonable to protect the purposes pursued by the measure”, states the project presented by the rapporteur minister.

The Court released the document on Monday through its website and it is expected that its debate will take place on April 4.

Last February an amparo judge declared unconstitutional This same lock, however, since it was a trial with guarantees, the declaration only benefited the complainant who requested the protection of the amparo.

Consequently, if eight ministers go along with Piña Hernández’s proposal, the ban must be removed from the law.
