Health plans, meal vouchers and other extra benefits have increasingly gained weight in the dispute for talents in the job market. But are these items an obligation of companies or a competitive differential?
According to the Consolidation of Labor Laws (CLT), the employer has no obligation to offer food stamps, meal vouchers or health insurance. However, when these benefits are in employment contract, convention or collective agreement, they are mandatory for all employees.

“Collective rules can establish the obligation, values, forms of granting and conditions of use, the possibility or not to disclaim them from the employee’s salary, as well as limits for this discount,” explains labor lawyer Maria Fernanda Redi.
For people management experts, benefits are increasingly decisive when attracting employees. According to Luiz Eduardo Drouet, president of the Brazilian Association of Human Resources (ABRH-SP), professionals prioritize better working conditions.
“Companies that offer better benefits can attract the best talents and those that do not follow this path have much harder time hiring good professionals, and live with a superior turnover of employees,” he says.
Discount of the meal voucher/food
The meal voucher and food stamp are regulated by Federal Law 6,321/1976, which created the Worker Food Program (PAT), and also provided for in article 457 of the CLT.
Discounts must be foreseen in collective norm or written individual agreement. The amount may not exceed 20% of the employee’s salary and must be described in the payroll.
According to labor lawyer Maria Fernanda Redi, the discount must be stated in the employment contract or to have express permission of the employee. Companies that adhere to PAT receive tax incentives to grant the benefit.
“The company that performs voluntary adhesion to the PAT, can provide the employee food voucher/meal and, in return, receives a series of tax incentives, such as the deduction in income tax,” explains labor lawyer Luciana Guerra Fogarolli.
Improper use can lead to dismissal
The valley should be used exclusively for food, as provided for in Federal Law 14.442/2022. This includes restaurant meals or food purchase in commercial establishments.
Misuse, such as lending the card to third parties, selling, exchanging for money or buying non -food products, can lead to dismissal for just cause.
“The employer, in addition to making the rules of use of the benefit very clear, must observe the gradativity of warning penalties and suspensions, before making the drastic decision to dismiss the worker for just cause,” says Luciana Guerra Fogarolli.
In 2023, more than 20 goal officials were fired for using the meal voucher to buy products such as soap powder, toothpaste and wine bowls instead of food.
HEALTH PLAN DISCOUNT
In relation to the health plan, regulated by Federal Law 9.656/1998, there is no minimum or maximum limit defined by law. In practice, the amount usually does not exceed 30% of the worker’s net salary.
Jurisprudential Guidance No. 18 of the Superior Labor Court (TST) also establishes that the sum of all discounts cannot exceed 70% of the base salary, so as not to compromise the employee’s subsistence.
“Any salary discount (to pay a monthly part or amount of the plan) must be authorized by the employee, in writing, as a clause in the employment contract. Another possibility is the employee signs a term of adhesion to the benefit or policy of granting the benefit,” explains Maria Fernanda Redi.
