Private Nursing Home Sector Challenges Ordinance on Bed Removal: Constitutional Court Appeal

The private nursing home sector is appealing to the Constitutional Court once morest the ordinance which plans to remove beds for the benefit of the public and non-commercial, indicates the newspaper L’Echo.

The ordinance referred to is an initiative of the Minister in charge of Social Action and Health Alain Maron (Ecolo). This provides that each year, private rest homes lose their approval for half of their unoccupied beds (with a tolerance of 5%). The objective is to reach at least 50% of public or non-commercial beds in the region, explains Echo. The minister thus wants to fight once morest the “commodification of care”.

This measure raises concerns with the private sector, which accuses “pure and simple expropriation”. Aedifica, Cofinimmo and Care Property Invest, Care-Ion and the sectoral federation Femarbel decided to challenge the order before the Constitutional Court at the end of July.
