However, there is no evidence to properly establish that American weapons have been involved in violations of international law, according to the report. Biden’s administration therefore says that the findings do not give reason to stop arms aid to Israel.
This is nevertheless the strongest statement on the matter from the US authorities.
– Due to Israel’s significant reliance on US-made defense material, it is reasonable to assume that material has been used by Israeli security forces since October 7 in violation of obligations under international humanitarian law, the report states.
Criticism within the party
US Foreign Minister Antony Blinken originally had until Wednesday to send the report to Congress, but it was not done until Friday. The report was commissioned by Biden, who has long been under pressure from a number of Democrats in Congress.
It claims that the chaotic nature of the war does not make it possible to obtain hard-hitting evidence of violations of international law.
Democratic Sen. Chris Van Hollen says the Biden administration has shied away from all tough questions.
– This report contradicts itself because it concludes that there is reason to believe that there has been a violation of international law, but it also says that it finds no violation, he says.
Claims Israel cares
The report also states that individual cases of violations of international law do not necessarily undermine Israel’s obligation to follow international law, as long as those investigating incidents take steps to prevent it.
– Israel’s own concern surrounding such incidents is reflected in the fact that they have a large number of internal investigations underway, it says.
Israel also has the experience, technology and know-how needed to minimize civilian suffering, according to the report. But the reality on the ground makes it reasonable to ask questions regarding whether the IDF uses the weapons effectively in all cases, it says.
Rafah-ultimatum
Biden has previously acknowledged that US bombs have been used in attacks that have killed civilians.
Among those who have advocated freezing arms support to Israel as a result of the war in Gaza is party veteran Nancy Pelosi.
The Biden administration is withholding a shipment of 3,500 bombs, and this week the president threatened to stop several other shipments if Israel takes seriously the threat of a ground invasion in Rafah.
