The Namur criminal court on Wednesday handed down prison sentences of 6 and 10 months and fines of 8,000 euros once morest two defendants convicted of involuntary manslaughter and non-declaration of dimona.

Absent at the hearing, the two defendants, scrap metal workers by profession, had come to the aid of a homeless man from Maubeuge, offering to work for them in exchange for room and board. On July 25, 2022 in Viroinval, this man, who had consumed alcoholic drinks provided by the defendants in the morning, fell into a trailer and opened his chin strap once morest a mudguard. He was airlifted to Godinne hospital, where he died. Analyzes revealed the presence of 2.45 grams of alcohol per liter in his blood.

Interviewed as part of the investigation, the two men stated that, to work for them (sorting scrap metal, dismantling cars, etc.), he had asked to receive 2 strong beers in the morning and the same thing in the evening. On the day of the incident, he had drunk a bottle of sparkling wine in the morning.

The prosecutor’s office considered that involuntary homicide had taken place and that there was indeed a relationship of subordination between the victim and the defendants. As such, they should have declared their employee but also provided them with appropriate work clothing and carried out a risk analysis.
