Concurrent civil and criminal legal proceedings are filed, and actions will be taken before the lunar calendar.
It is understood that the four public banks, including Tuyin Bank, Taiwan Bank, Zhangyin, and Huayin Bank, did not make a clear statement on the legal proceedings, but only said that they must go back and ask the chief for instructions before making a decision. The members of the banking group believe that there are now differences of opinion among the Investor creditor banks on whether to file a lawsuit, and the reason is closely related to “business considerations”.
According to people familiar with the matter, Inventec has taken action this week to visit important correspondent banks that are also creditor banks of Inventec in batches. It is pointed out that Inventec mainly told the bank that since Inventec’s single legal person holds only 30% of the shares of Inventec, if it repays the amount of 1.8 billion creditor’s rights for Inventec, it will also be betrayed by its own shareholders. I’m afraid this road will not work.
However, Inventec immediately proposed another set of solutions to the bank on the spot. There are three main points, including: 1. Willing to let the bank reduce its deposit interest rate 2. Willing to accept the bank to raise the lending rate to Inventec 3. Inventec There are tens of thousands of employees under the group. In the future, Inventec is willing to come forward to help with the marketing of housing loan, credit and other consumer gold business, so that the bank can do more business.
People in the financial circle believe that this may be an important factor in the inability to integrate opinions between the Angwind creditor bank groups. After all, it is not an easy road to fight legal proceedings, and banks also have their own business and business to take care of and do. The bank will also calculate the difference between the overweight business plan proposed by Inventec and the loss of the bank’s Inventec creditor’s rights. If the former can be higher than the latter, the bank will then consider whether to insist on legal proceedings.
As for the US$500 million joint loan case organized by Huanan Bank for Inventec more than two years ago, it is understood that it will expire in October this year, and it is expected to organize a new joint loan to repay the old one in the second quarter of this year. Even if other public-stock banks except Mega Bank do not file legal lawsuits against Inventec, after the Inventec incident, Inventec’s joint loan case will be renewed, and the interest rate will definitely be raised.
In terms of filing legal proceedings, according to the legal opinion previously submitted by Mega Bank to Wanguo Law Firm, it has been clearly suggested that Mega Bank may, in accordance with the provisions of Article 23 of the Company Law and Article 154 of the Company Law, file charges against Invinda respectively. The directors, and Inventec filed a civil claim. In addition, for criminal fraud, there is room for litigation by lawyers’ assessment.
