Sexual criminal law: Council of States wants the no solution

The Federal Council and the Legal Commission of the Council of States want a no to be enough for a sexual act to be punishable. However, they reject the consent solution, according to which active consent is required for impunity. This consent solution is in force in various European countries: According to SRF, it applies in Belgium, Germany, Denmark, Greece, Ireland, Iceland, Croatia, Luxembourg, Malta, Sweden, Slovenia, Spain and Cyprus.
