When the UK’s Competition and Markets Authority decided to oppose Microsoft’s $68.7 billion acquisition of Activision Blizzard King, ultimately preventing the deal from being completed in the UK, it didn’t take long for Microsoft to initiate a review process. The CMA had been pushing to postpone the trial until October in the circumstances, but the UK’s Competition Appeal Tribunal decided to prevent that from happening and block the CMA’s attempt to delay the hearing. Specifically, the CAT states: “This issue is important and any new attorney will need to digest a considerable amount of material, but we estimate that one month will be sufficient for this purpose – provided that the CMA selects an attorney with appropriate availability to prepare, especially considering to the support of the CMA and its existing team of lawyers. The question itself is answered: this is a team that should have sufficient time to ensure that the CMA’s defense of the application is properly handled. This means that whether or not the CMA has the opportunity to prepare a specific case , a retrial to decide whether the UK approves or continues to block a mega-merger will begin at the end of next month.
