And for good reason: employers’ organizations, which nevertheless have no shortage of demands when it comes to simplifying and securing businesses, do not understand why the government is so keen to reduce the appeal deadlines in the event of dismissal.
Friday, Olivier Dussopt gave another layer on the subject, in The echoes. “We have a subject of simplification, including the question of the time limit for challenging legal proceedings in the event of dismissal. We have one of the longest deadlines in Europe and this can slow down hiring. I would like a sufficient period of time, but twelve months it’s too long,” explains the Minister of Labor.
“If he wants to do it, let him do it. Anything that contributes to securing companies is always good to take but it is a cosmetic measure,” whispers a management official.
And added: “If the government really wants to simplify life for businesses, it should rather remove the thresholds from 50 employees”.
Deadlines divided by 30 in 15 years
These time limits for challenging legal proceedings following a dismissal have already been considerably reduced in recent years. We went from 30 years to 5 years in 2008, then two years in 2013 and finally one year in 2017. Already at that time, the government wanted to go further and reduce this period to six months. The measure was abandoned under pressure from trade union organizations. Suffice to say that Bruno Le Maire’s proposal, which consists of reducing this period from 12 to 2 months, has employee representatives screaming.
This is also the other criticism of employers’ organizations. “By doing this, the government risks adding fuel to the fire in an already tense social climate,” laments a boss. Especially since between the capping of industrial tribunal compensation, the tightening of the conditions for opening unemployment rights, the degression of benefits or more recently, the reduction in the duration of compensation depending on the economic situation, the government has already reduced the rights of the unemployed a lot.
