The Guatemalan Army confirmed that the man who was arrested last Sunday accused of the death of three people in zone 16 of the capital is a sergeant of that institution and details what happens now that he is linked to the process.
The Public Ministry identified the detainee as Christian Aroldo Heinemann Aguirre, who was linked to proceedings for the crime of homicide to the detriment of two men and a woman, following an armed incident that occurred in the early hours of Sunday, March 3 in zone 16 of the Guatemala city.
The fatalities were identified as Jersón David Barrera de Ajavix, 21 years old, and Ángel Estuardo Trujiño Ajavix, 30, residents of zone 3 of the capital, who were in the Cayalá sector, zone 16 for a musical concert.
The third victim was identified as Diana Chinchilla Méndez, 31, who was pregnant and was killed by a stray bullet.
According to initial investigations, Sergeant Heinemann Aguirre was waiting for his wife to leave the aforementioned concert.
At the end of the concert, Barrera de Ajavix and Trujiño Ajavix found their car with broken windows and that’s why they argued with a supposed car caretaker, but the situation got out of control and that would have forced the now detained man to fire his gun.
The two men and the woman died in the incident, who was returning home following listening to the concert on public roads and was accompanied by two children.
Christian Aroldo Heinemann Aguirre, following being linked to the process, was interviewed and told the media that he had shot in self-defense.
According to him, several men attacked him, although he does not know if they were trying to assault him, so he was forced to draw his gun and shoot.
Rubén Téllez, spokesman for the Guatemalan Army, commented that in this case, because the sergeant was on rest while the situation occurred, it is unrelated to the service.
He pointed out that this person must respond personally and individually before the courts or the prosecutor’s office handling the case.
He explained that this person is under the control of these authorities and with the preventive measures that they can take.
Téllez said that if the soldier is found guilty, then he will automatically be discharged from the Army, and if he is not found guilty, an internal administrative investigation process might still proceed and see if he incurred any misconduct and sanction him accordingly.
This might also include retirement from the ranks of the Army.
The Prosecutor’s Office for Crimes once morest the Life and Integrity of Persons, of the Public Ministry, reported that it presented sufficient rational evidence before the Court of First Instance for Criminal, Narcoactivity and Crimes once morest the Environment on duty, who decided to issue an indictment once morest Heinemann Aguirre, for the crime of homicide to the detriment of three people.
He added that the court also decided to send the sergeant to preventive detention, and grant the Public Ministry a period of 3 months to conclude the investigation.
