Georgia Woman Charged with Murder After Taking Abortion Pills

A Georgia woman has been charged with murder after experiencing complications following a self-managed abortion, a case that is raising questions about the enforcement of the state’s near-total abortion ban.

Alexia Moore, 31, was arrested and jailed after seeking hospital treatment in December for pain related to taking abortion pills purchased online, according to reports from The Washington Post and USA Today. Moore delivered a fetus estimated to be between 22 and 24 weeks of gestation, which displayed cardiac activity before dying approximately one hour later.

The arrest warrant alleges that Moore knowingly caused the death “of a human being who was born alive and survived for one hour,” citing Georgia law which defines a fetus as a person upon live birth. Investigators were alerted to the situation by a hospital security guard who reported Moore’s pregnancy and subsequent abortion to police, though she was not arrested until this week.

Moore had told doctors she had taken misoprostol, also known as Cytotec, to induce the abortion, and also admitted to taking oxycodone for pain relief. According to the warrant, she was unaware of the precise number of weeks she had been pregnant.

Georgia’s “heartbeat law,” enacted in 2019 and enforced after the overturning of Roe v. Wade in 2022, prohibits abortions once fetal cardiac activity can be detected – typically around six weeks of pregnancy. The law includes exceptions for rape, incest, and medical emergencies.

This case marks the first instance of a woman being prosecuted under the Georgia law, according to reports. Elizabeth Edmonds, executive director of the anti-abortion group Georgia Life Alliance, released a statement asserting that the case is being investigated and prosecuted “like any other” death, referring to the fetus as “an innocent baby girl.”

However, reproductive rights advocates argue that the prosecution represents a dangerous overreach of the law. Rachana Desai Martin, chief U.S. Program officer for the Center for Reproductive Rights, stated that abortion bans do not eliminate abortions, but instead force individuals to seek them outside of the formal medical system.

A fact check by EWTN News has challenged initial reporting that Moore was charged specifically under the state’s abortion law, but confirmed that she was charged with murder in connection with the death of the fetus.
