Preventive detentions largely contribute to this overcrowding. These people temporarily deprived of their liberty await a verdict in their case. More than one in three detainees is in this situation, report De Standaard and Het Nieuwsblad on Monday on the basis of figures from Minister of Justice Vincent Van Quickenborne (Open VLD), provided in response to a parliamentary question.

“With 36% of detainees in pre-trial detention, our country is above the European average”, comments MP Sophie De Wit (V-VA), who addressed this question to the Minister. The European average is 29%. The Netherlands are also above the average, but France and Germany just below.

The figures provided by the Minister also indicate that half of the people in preventive detention are foreign nationals. The majority of these detainees do not have a residence permit for Belgium.
