The acts of harassment took place between 2018 and 2020 in a rest home in the province of Namur. The defendant is a nurse and the victim was a nursing assistant in this institution. This pair had to work alone at night. The defendant believed that a rapprochement had taken place between him and the complainant during the period of the Covid-19 pandemic. He confirmed sexual acts, but assured that she consented. A similar scene took place on the night of December 11 to 12, when the victim was actually asleep.
The latter’s lawyer specified that his client has been incapacitated since the events and suffered a disability of 66% following the after-effects from which she suffered.
The defense requested acquittal, arguing that the penetration was consensual, that the victim behaved in an exuberant manner and played games of seduction with other male colleagues.
