Alejandra Frausto violates the ban in Chapultepec Ministry of Culture and the Government of Mexico City inaugurated yesterday Saturday the “PARCUR” Urban Culture Parkbefore Atlantis, with the First Festival of Urban Culture as “part of the actions of the Chapultepec, Nature and Culture project”, a priority project for both agencies. With this act, in which Alejandra Frausto and Claudia Sheinbaum participated, was the Constitution violated?

The first to speak were urban artists, who thanked the recovery of the space; a Mayan singer who participates in a program of the Ministry of Culture spoke about the promotion of native languages ​​and thanked the institutions for recognizing urban culture. Then, Secretary Frausto said that cultural diversity was seen “with classism” and that “never” had there been a “program that would serve this great cultural expression in a dignified manner.”

And he said that this space was “thought by President Andrés Manuel López Obrador, he imagined this place for you to be worthy, be free, enjoy and live through your own identity.”

The next to speak was Sheinbaum and she also said that López Obrador “since he entered the government he defined a project called Chapultepec, Culture and Nature, and the objective is to open more public spaces. This place was privatized and today it is a space and that is fundamental, public space is a right to the city”.

And from there the whole project was highlighted, that there will be a film library, an art warehouse, that more than 50 hectares will be added.

Does this violate the Constitution? Let’s see: in Article 35, section IX, it is established that during the time that the mandate revocation process comprises, from the call and until the conclusion of the day, “the dissemination in the media of all government propaganda must be suspended of any order of government.

It is true that Article 4 says that “every person has the right to access culture and to enjoy the goods and services provided by the State in this area, as well as the exercise of their cultural rights”, in such a way that what happened yesterday afternoon could be translated as a guarantee of that right.

But Constitutional Article 35 also says that in this closed season that ends on April 10, “the public authorities, the autonomous bodies, the dependencies and entities of the public administration and any other entity of the three orders of government, may only broadcast the campaigns of information relating to educational and health services or those necessary for civil protection”.

The matter is very clear. Talking about an infrastructure project, about the figure of the Executive Power, is not a matter of education, health or civil protection.

The counselor of the INE, Ciro Murayama warned a couple of days ago that it was Morena who included in the Constitution the prohibition of government propaganda during the Revocation.

A few days ago, the PAN denounced to the INE that the supervision of the president of the “Tomás Oroz Gaytán” stadium was “government propaganda” because it was about “government achievements, actions and programs.” The INE determined that the actions of the Executive Power were highlighted because they were linked to the operation of social programs and ordered that all publications related to that fact be eliminated.

Will someone file a complaint with the INE to determine whether or not they violated the Revocation ban?
