Thiruvananthapuram ∙ Perumbavoor MLA Eldos Kunnappilly granted anticipatory bail with strict conditions. The Sessions Court has granted bail with 11 conditions, including that he must appear before the investigating officer at 9 am tomorrow. The prosecution has decided to appeal against the verdict.
Other conditions are: Appear for questioning between 9 am and 7 pm till November 1 if requested by the investigating officer. Mobile phone and passport must be submitted to the court. Do not make inflammatory posts against the complainant on social media. Do not leave Kerala without the permission of the court. Do not influence the complainant or witnesses. Details of social media accounts should be handed over to the investigating officer. Cooperate fully with the investigation. Do not commit similar crimes while on bail. 5 lakhs or equivalent personal surety.
After hearing the side of the complainant in the morning, the judgment was given in the afternoon. The prosecution argued that Eldos should not be granted bail. The case is also for attempted murder. The complainant has stated that there are other accused. Eldos needs police custody to find them and conduct further investigation. The prosecution also said that if bail is granted, evidence may be destroyed.
Eldos’ argument was that the complainant did not raise the harassment when she filed the complaint on the 28th of last month and later the allegation was made as part of blackmailing. The complainant is the accused in many cases. Even against a CI and an SI, there are two warrants against the complainant who has made allegations of harassment.
In connection with an investigation at the cantonment station, there is also a police report that the complainant is the person who regularly raises such complaints and is unreliable. A molestation case has also been filed against her ex-husbands. The complainant, who first said that she was abducted, later alleged that she was caught. After that, an attempt was made to kill him. People like this cannot be trusted. The defense lawyer also said that it should be suspected that this is a move by the administration to destroy the political future of Eldos.
The court observed that during the trial, it should be found that what was done against the woman was torture. The complainant did not testify that the harassment took place in the first instance. The complainant, who has higher educational qualifications, has never been in any form of imprisonment. He did not tell the doctor even after reaching the hospital. The court took into account the fact that there are no criminal charges against Eldos and that there is a close relationship between the complainant and the accused for granting bail. But Eldos’s lawyer Kuttiani Sudhir said that Eldos is not absconding and will appear before the investigating officer tomorrow.
