Lawyer Lightning Anofial Asmid, Brahmonojati said the trial was waiting for reinforcement from the DJKI Kemenkumham. Today’s hearing is scheduled to read the lawsuit. Previously, Atta Halilintar’s father sued DJKI Kemenkumham for filing a trademark.
“Today, we are waiting for the trial agenda to read the lawsuit from the defendant,” said Brahmono Jati at the Central Jakarta District Court, Bungur Region, Central Jakarta on Monday (22/8/2022).
Brahmono also said Atta Halilintar’s father maintained the brand. Previously, DJKI rejected the trademark application process.

“My client is in order to maintain the brand and that has also been regulated by law. The point is that our client wants to maintain his brand, the process is being pursued. That’s right, the DJKI process has a rejection from the DJKI,” he explained.
Talking about the reason for the rejection, Brahmono said that the brand had been registered by someone else first.
“Because it was considered that someone had registered earlier in 2017, the applicant from Gen Halilintar defended it, so it was pursued until this lawsuit,” he explained.
Lightning Anofial Asmid sued the Ministry of Law and Human Rights on August 4, 2022. Halilintar Anofial Asmid’s lawsuit is registered under number 75/Pdt.Sus-HKI/Merek/2022/PN Niaga Jkt.Pst.
The defendant in the lawsuit is listed under the name of THE GOVERNMENT OF THE REPUBLIC OF INDONESIA Cq KEMENKUM HAM RI Cq DIRECTORATE GENERAL OF INTELLECTUAL PROPERTY Cq THE BRAND APPEAL COMMISSION.
Anofial Asmid still fighting for the Gen Halilintar brand which was registered with the Ministry of Law and Human Rights was rejected. There are four points of the lawsuit that became the demands of Halilintar Anofial Asmid.
The first point is to accept and grant all of the plaintiff’s claims. Second, declare null and void the decision of the Mark Appeal Commission or the defendant Number 375/KBM/HKI/2020 dated September 8, 2020.
Third, requires the defendant to order DJKI (Directorate General of Intellectual Property) to accept the application for registration of the mark ‘GENHALILINTAR + Painting’ agenda number D002018027834 and issue a certificate of mark ‘GENHALILINTAR + Painting’ on behalf of the plaintiff, namely Halilintar Anofial Asmid.
Fourth, punish the defendant to pay all court costs.
