Barthélémy soon to be built by the Supreme Court

Barthélémy Dias’ legal marathon has not yet come to an end. This murder case lasted more than 11 years in which the current mayor of the city of Dakar is quoted does not yet seem to be completely cleared up.

After the verdict of the Court of Appeal confirming the sentence of 2 years, 6 of which are firm, the deputy-mayor Barthélémy Dias and his advisers decided to seize the Supreme Court to reverse the verdict rendered by the first courts.

According to the sources of the newspaper Les Echos, the case has arrived at the Supreme Court. The case is in the circuit and will soon be scheduled, indicates the same source.

Recognized guilty of the offense of “mortal blows” by the criminal court, Dias-fils risks losing his post as mayor of the City of Dakar with the confirmation of this sentence by the supreme court. Ditto for his position as deputy?

Indeed, article 51 of the internal regulations of the National Assembly, inspired by the last paragraph of article 61 of the constitution, provides: “the deputy who is the subject of a final criminal conviction is removed from the list of deputies of the National Assembly at the request of the Minister of Justice”.

At first instance, the socialist political leader faced a 10-year prison sentence. This is what the prosecution had held against him. But, finally the judge had imposed a sentence of 6 months in prison.

Indeed, Barthélémy Dias and his co-accused were prosecuted for mortal blows, unlawful assembly, possession of a weapon without administrative authorization, intentional assault and battery, death threats. The facts date back to December 2011.

Ndiaga Diouf was killed and three others injured following the attack on the premises of the town hall of Sicap-Mermoz by thugs, during which there was an exchange of fire.

At the time, Barthélémy Dias said: “I fired two warning shots. They were too many. I opened fire on the crowd. They were armed and we fought for half an hour. And indeed, if I’m not mistaken, two or three people fell. »
