The Nord prefecture said on Monday that it had sanctioned Basic Fit for misinforming consumers about the subscriptions offered by the company, reportedThe voice of the North.
A “lack of consumer information”
At the end of an investigation by agents of competition, consumption and the repression of fraud (CCRF), the company was fined 68,500 euros. The prefecture indicates that several shortcomings have been noted by the investigators, on the Basic Fit websites but also in sports halls.
In particular, Basic Fit is accused of a “failure to inform consumers before they take out their subscription, in particular on its termination conditions and on the possibility of seizing a consumer mediator in the event of a dispute” as well as an “absence invoice discount”.
The Basic Fit websites “presented prohibited clauses in their general conditions of sale”, notes the prefecture, which adds that they did not “include certain information to be provided to consumers before taking out their subscription”.
A sanction visible on the Basic Fit website
The Basic Fit online store – inaccessible this Monday at the end of the afternoon – “did not provide consumers with contractual information on a durable medium, as is mandatory in the context of a contract concluded at a distance” and ” did not inform consumers of their right to oppose cold calling thanks to Bloctel”.
The company is also accused of having presented consumer opinions “without specifying their mode of collection and moderation”.
This Monday, a yellow banner had appeared at the top of the Basic Fit website, with the announcement of this sanction.
In early June, several influencers pinned by the Directorate General for Competition, Consumer Affairs and Fraud Prevention (DGCCRF) were forced to post the sanctions imposed on them on their Instagram accounts, and thus inform their thousands of subscribers. Posts had to remain viewable for 30 days.
