Boric Government withdraws Piñera’s project to transfer beaches to private companies and promote investment | National

The measure was presented in mid-November 2021 and made no progress in its first constitutional process in the Senate. The idea was to promote property and also investment in the northern macrozone.

On Tuesday, through a message to the Senate, President Gabriel Boric announced his decision to withdraw a bill on beaches.

The measure, specifically, had been presented by former President Sebastián Piñera on Monday, November 15, 2021, according to the parliamentary records.

These themselves indicate that the idea never passed its first constitutional process and that the only advance it had was in mid-April, a first report from the Environment Commission.

The text proposed transferring domains of public beach land on an exceptional basis in order to regularize ownership and promote investment.

“The so-called ‘fiscal beach lands’ correspond to those located in the strip located at a distance of up to 80 meters wide, measured from the beach line of the coastline or the line of the highest tides”, started the Project.

“These are properties of fiscal domain, not national assets for public use, which are part of the coastline of our country, whose administration is delivered to the Ministry of National Defense through the Undersecretariat for the Armed Forces”complemented the previous government.

Transfer of tax beaches to encourage ownership and investment

“One of the main foundations of this bill is related to resolve the situation of occupations on public landspecifically of those located on the coastal edge of the northern macrozone of our country, including the regions of Arica and Parinacota, Tarapacá, Antofagasta and Atacama”, reads the text, under the chapter on the arguments behind the proposal.

That section also included points such as “consolidate the situation of holders of rights of use and enjoyment in public beach land” and “promote regional economic development”.

Yes indeed, any transfer could continue its course only with a favorable report from the Undersecretariat for the Armed Forcesin order to safeguard the powers and competences that the law has granted to the Ministry of Defense.

The message of “processing completed” already appears on the Senate website.
