Box: no response from Anses, Schiaretti prepares the lawsuit in the Supreme Court

Given the lack of response from the national government to the summons to initiate a lawsuit before the Supreme Court of Justice, to claim a debt of 110 billion pesos, Governor Juan Schiaretti ordered his legal advisors to prepare the lawsuit to present it at the end of the Of the next week.

The legal team of the Province, headed by the State Attorney, Jorge Córdoba, together with the legal advisors of the Retirement Fund and a prestigious Buenos Aires law firm will be responsible for drafting the lawsuit, which would be between Thursday and Friday of next week.

The García Lema legal firm, one of the most recognized in the Federal Capital, will once again participate in the legal strategy of the Government of Córdoba, in the eventual trial against the Nation, before the highest court of justice.

Alberto García Lema had represented Córdoba in the previous trial against the Anses, which was initiated by the then governor José Manuel de la Sota, in 2012.

In that trial, the Supreme Court agreed with Córdoba, in a 2015 ruling, for an initial debt of 1,040 million pesos.

Intimation

“No news,” commented a member of the provincial cabinet, when asked if there was any response from President Alberto Fernández or the Anses.

Last Wednesday, from the Civic Center it was reported that the governor had sent a letter to President Alberto Fernández, with an intimation that in the “term of five days”, Córdoba be paid 110 billion pesos, a debt that Anses contracted with the Caja de Jubilaciones de Córdoba.

The provincial president claims the debt of the differences between the advances and what the Anses should turn, in the years 2020, 2021 and 2022.

Added to this debt is the failure to send the quotas for January and February, which appear in the Budget for this year.

According to the calculation of the Retirement Fund and the provincial Ministry of Finance, the Anses must turn this year, before the 20th of each month, 4,300 million pesos.

There are two levels of credits. Those of the three previous years, the officials of the Anses and the Retirement Fund must sit down to negotiate the amount of that debt, despite the fact that the Schiarettista management gave it specific numbers: 41,607 in 2020; 26,403 in 2021 and 32,325 in 2022.

The Anses is the body that generated the debt with the Córdoba Retirement Fund, but the governor decided to send the summons to the President of the Nation himself.

Córdoba is not the only province affected by the breaches of the Anses. The other 12 provinces that did not transfer their pension funds did not receive a peso so far this year either.

The versions indicate that Schiaretti spoke with his colleague from Santa Fe, Omar Perotti, to coordinate a claim strategy against the Nation.

The Government of Santa Fe made an administrative claim before the Anses, but for now, it will not initiate a lawsuit against the national Government.

Perotti has to face serious problems of insecurity and drug trafficking in Rosario, a situation that led President Alberto Fernández to send federal forces to that city. In this context, the Santa Fe president is not in a position to get involved in a lawsuit against the Casa Rosada.

Due to this situation, Schiaretti decided this week to intimidate the national government to pay the debt. Nobody in the Civic Center believes that there will be a favorable response.

Perhaps, most likely, Anses will pay some of the two installments it owes this year, but the governor of Córdoba claims a debt for the three previous years.

The schiarettista officials consider that it is “unlikely” that the Nation will sit down to negotiate the debt for the previous three years, for which reason, work has already begun on the lawsuit that will be presented next week before the Supreme Court.
