Boy died after birth: trial against doctor

Doctor will be in court on Tuesday for gross negligent homicide.

A doctor from the Vöcklabruck Clinic will be tried at the Wels Regional Court on Tuesday in connection with a delivery that ended in a catastrophe. It’s about the death of a boy from a family from the Hausruckviertel bordering the Flachgau, who suffered severe brain damage in December 2021 during a birth – which was ultimately carried out via an acutely necessary emergency cesarean section. The boy was then transferred to the Salzburg University Hospital and died eight days later. The doctor is accused of significant breaches of his professional duty of care. According to the criminal complaint, in this specific case he is said to have failed to carry out a specialist medical assessment of the various modes of birth” and “overall not to have provided any (…) care to the birthing mother that was adequate to the birth risk.”

The doctor – for whom the presumption of innocence applies – is not only accused of grossly negligent homicide in relation to the boy, but also of negligent bodily harm in relation to the mother. The doctor was also responsible for the fact that the woman suffered a ruptured uterus during childbirth and only survived thanks to an emergency operation “as a result of medical errors in treatment” and inadequate information.

The boy’s parents are represented by Salzburg lawyer Stefan Rieder.
