CC receives protection against the state of Calamity declared by Arévalo

This Thursday, April 11, the Constitutional Court (CC) received an injunction against the state of Calamity decreed by the President of the Republic Bernardo Arévalo.

The amparo indicates violation of a series of constitutional guarantees. The state of Calamity is derived from the forest fires that affect the country, there is also that of the landfill of the Authority for the Sustainable Management of the Basin and Lake of Amatitlán (Amsa).

On Tuesday, April 9, the National Coordinator for Disaster Reduction (Conred) reported that at least 37 forest fires in the current season have been caused, for which it presented actions to the Public Ministry.

The protection before the CC was presented by Deyanira Elizardi Díaz and Diego Sagastume Vidaurre.

Among the accusations are: Public function and subjection to the law, abuse of authority and breach of duties.

It also mentions the rights inherent to the person and article 44 of the Constitution, which indicates that laws and governmental provisions or any other order that diminish, restrict or distort the rights that the Constitution guarantees will be void.

During a press conference on April 10, the president said that the Council of Ministers decided to declare a state of Calamity and that the current situation is not a coincidence, since according to Conred, at least 80% of forest fires have been caused.

According to Arévalo, only institutions that have “a strategic role” will be able to execute the funds and, upon completion of this provision, a financial report of what has been done will be presented.

The State of Calamity allows entities to make purchases without bidding and limit some civil guarantees.
