COBIN claims/”diesel-klage.at”: Further legal steps in the VW “exhaust scandal” planned

“Compulsory update” for engines of the EA189 series unreasonable / update led to damage and restricted use

Vienna (OTS) The “diesel-klage.at” campaign – initiated by the non-profit association COBIN claims – sees its legal view fully confirmed by today’s warning from the ÖAMTC to customers of the VW Group and announces further legal steps. The club warns that there is a risk that the license plates of “diesel scandal” cars will be removed if drivers have not had the so-called “update” carried out.

But drivers are in a bind: In a survey of more than 1,600 participants in the campaign, “diesel-klage.at” has already shown that this software update leads to damage or increased wear and tear and restricted use of the cars, whereupon the ÖAMTC also refers.

The ECJ has just found that the update still contains an illegal defeat device. The Austrian Supreme Court did not reach any other conclusion and stated that the update does not correct the original defect, the so-called “cheat software”. In Germany, the VG Schleswig-Holstein sentenced Volkswagen AG to revise the update, as otherwise there would be restrictive measures in all member states, up to and including closure.

“Against this background, we will immediately submit applications for declaratory judgments to the responsible motor vehicle authorities, so that there is legal certainty for our participants,” say Severin Hammer, the lawyer who specializes in the VW case and COBIN claims Vice Chairman of the Advisory Board and COBIN claims chairman and “diesel-klage.at”. -Managing Director Oliver Jaindl.
