On February 16, the Hanoi People’s Court returned the file, requesting additional investigation into the case of abusing positions and powers while on official duty, which occurred at the Maritime Labor Export Company (MMS) due to its inability to comparing data between two civil plaintiffs, Vinalines, MMS Company and related parties.

According to the indictment, MMS Company is a state-owned enterprise, dependent on and bound by the parent company, Vietnam National Shipping Lines (Vinalines), in which Vinalines authorizes MMS to perform export services. labor.

From October 2014 to March 2016, through the Hanoi Office, Nguyen Quang Ngu – MMS Director signed 539 trainee contracts to Japan with a brokerage fee of USD 1,500/person. The total amount collected is 17.5 billion VND.

In fact, MMS only collects 400 USD/person, the rest is 1,100 USD/person used by the Hanoi Office.

To legalize this amount, Ngu agreed with Pham The Tai (Deputy Head of Finance and Accounting Department), Nguyen Thi Tuoi (Deputy Director cum Head of Hanoi Office) to give the intern the cost of air tickets, expenses for house rental, Japanese language training, salary and bonus, remuneration, per-unit travel expenses, etc. to the accounting.

The problem is that according to the Cooperation Agreement between the Government of Vietnam – Japan and the regulations of the Ministry of Labour, Invalids and Social Affairs, the cost of round-trip airfare for the intern is to be paid by the Japanese receiving organization.

Separating this amount along with the incorrect accounting amounts, the Hanoi People’s Procuracy determined that the three defendants Ngu, Tuoi and Tai had caused more than VND 12.3 billion in damage to MMS and Vinalines.

In addition to the above-proven part, during the investigation, the authorities compared with 851 trainees who came to carry out procedures for contract liquidation with MMS as of March 2020, the total amount they paid recorded and paid is 119 billion dong, while MMS’s receipt according to the invoice is only 16.6 billion dong – a difference of 102 billion dong.

This is an incomplete number, because from October 2014 to July 2017, the Hanoi Office of MMS recruited and signed a contract to bring 1,129 trainees to work in Japan.

To clarify this question, in December 2021, the Hanoi Police Investigation Agency entrusted the investigation agencies of 40 provinces and cities. On that basis, only 29 provinces have notified verification and recorded 144 trainees’ statements, the remaining 11 provinces have not responded to the results. Therefore, in March 2022, the Hanoi Public Security Bureau of Investigation decided to separate this content for investigation, verification and clarification later.

This is a complicated case that was initially prosecuted by the Ministry of Public Security’s Investment Police Agency and then transferred to the Hanoi Public Security Bureau of Investigation.
