Convicted kindergarten assistant still on duty

As the “Kurier” reported online on Thursday, the 19-year-old shared videos on Instagram in 2022 of veiled little girls beheading dolls and shouting the IS slogan “Islamic State will survive and expand”.

The convicted Turkish woman commented on these video clips with the words: “My child, one day, In sha Allah”. According to the report, she also confessed in court.

The case was not previously known in the elementary education department of the education department of the state of Upper Austria, but it is not responsible for the staff either. A spokeswoman for the Education Directorate said it was employed by the legal entities of the kindergartens. According to “Kurier”, the employer probably did not know about the conviction either. The person concerned was still a teenager at the time of the crime, so the crime falls under the limited information under the Repayment Act, court spokesman Walter Eichinger explained to the APA. As a result, sentences of up to six months for juveniles and young adults do not appear outside of the law enforcement authorities.

A professional ban against the young woman could not have been imposed in the process. This can only be pronounced by the judge “if it is an act against life and limb, freedom or the sexual integrity and self-determination of minors,” confirmed Eichinger. In the process in question, however, an “act against public peace” was negotiated.

He also noted that each “case is considered by the judge on a case-by-case basis”. The maximum sentence for the young kindergarten worker would have been five years. However, the judge stuck to the bottom with his verdict. Eichinger emphasized that it was “appropriate to the crime and to blame,” and neither the defense nor the public prosecutor’s office announced any complaints or appeals.
