The survivors and surviving soldiers who died in the 2nd Battle of Yeonpyeong won a lawsuit against the North Korean government and North Korean leader Kim Jong-un. However, due to the nature of inter-Korean relations, actual compensation is expected to be difficult.

According to the legal community on the 25th, Judge Kim Sang-geun, the sole civil 86 judge of the Seoul Central District Court, said in a lawsuit for damages filed by eight people, including the wife of Sergeant Han Sang-guk, the late chief of the high-speed boat in the Navy, “The defendant should pay 20 million won each to the plaintiffs, a total of 160 million won. “The judgment was made on the 23rd.

The court said, “North Korea is an anti-state organization that is not recognized as a state. He also accepted the plaintiff’s claim that “North Korea should be held responsible for the ‘war crimes’ of Kim Jong-il, the then legal representative, and his heir, Kim Jong-un in 2002.”

He won, but it was difficult to receive actual compensation in the precedent

The 2nd Battle of Yeonpyeong was a case of invasion of South Korea on June 29, 2002, when two North Korean patrol boats invaded the Northern Limit Line in the West Sea and made a surprise attack on the 357 Chamsuri of the South Korean Navy. Six people were killed, 19 people were injured, including Sergeant Major, Sgt. Seo Hoo-won, and Sgt. Dong-hyeok Park, and 357 boats sank during towing.

A boss’s wife and seven surviving soldiers filed a lawsuit against North Korea in 2020, claiming that “the defendants suffered physical and mental suffering due to the joint illegal acts.”

After that, the case proceeded by public service. Service by public notice is a system in which when the address of the party to whom the trial-related documents are to be delivered is unknown, the documents to be served are posted on the court bulletin board, etc.

However, it seems difficult for the survivors and surviving soldiers to receive actual compensation. Previously, Mr. Han and Mr. Noh, who had been captured by North Korean soldiers in the Korean War, also filed a lawsuit against North Korea and Chairman Kim and won the first trial in July 2020, but were unable to collect them.
