Crete: What will happen to the Courts of Appeal and the Courts of First Instance on the island? – 2024-04-10 17:48:38

The consolidation of the first degree of jurisdiction is foreseen by the draft law of the Ministry of Justice, which was presented today in a press conference of the Minister of Justice, Giorgos Floridis and the Deputy Minister of Justice, Ioannis Bougas.

In particular, with the draft law, which is expected to enter into force with the new judicial year, from September 16, 2024, the first degree of jurisdiction is consolidated, which means in practice that judicial formations are abolished and merged, which will be reduced from 217 to 11 and the “reservoir” of judges is doubled, as there will be a total of 2,100 judges.

As far as Crete is concerned, the bill of the Ministry of Justice briefly provides for the preservation of the Courts of Appeal of Crete and Eastern Crete and the preservation of the Courts of First Instance of Chania, Rethymno, Heraklion and Lasithi.

At the same time, all Magistrates’ Courts on the island are abolished, while Vamos is designated as the regional seat of the Court of First Instance for Chania, Moires for Heraklion and Sitia and Ierapetra for Lasithi.

In detail and with regard to the new judicial map in Crete, the bill provides for the following:

Article 6 Restructuring of civil and criminal courts of first instance and determination of their territorial jurisdiction

1. The seats and regions of the civil and criminal courts of first instance are defined as follows:

r) In the Regional Unit of Heraklion (former Prefecture of Heraklion) the Court of First Instance of Heraklion, as the central seat, and the Prosecutor’s Office of First Instance, with headquarters in Heraklion, are maintained. The District of the Court of First Instance of Heraklion includes the Municipalities of the Regional Unit of Heraklion. The Magistrates’ Courts of Heraklion, Pyrgos, Kastelli-Pediados and Moira are abolished. The organizational positions of the judicial and prosecutorial officers and court employees serving there are transferred to the Court of First Instance of Heraklion. Moires is defined as the regional seat of the Court of First Instance of Heraklion, under whose jurisdiction fall the Municipalities of Phaistos and Gortyna.

The organic positions of judges and prosecutors of the Court of First Instance of Heraklion are defined as follows: a) Presidents of First Instance: six (6), b) First Instance Judges: forty one (41), c) Judicial Paredes: two (2), d) First Instance Prosecutors: three ( 3), e) Deputy Prosecutors of First Instance: six (6), f) Prosecuting Attorney: one (1). The organic positions of judicial officers of the Court of First Instance of Heraklion amount to one hundred and seventeen (117).

ld) In the Regional Unit of Lasithi (former Prefecture of Lasithi), the Court of First Instance of Lasithi, as the central seat, and the Prosecutor’s Office of First Instance, with headquarters in Neapoli, are maintained. The District of the Court of First Instance of Lasithi includes the Municipalities of the Lasithi Regional Unit. The Magistrates’ Courts of Lasithi, Sitia and Ierapetra are abolished. The organizational positions of the judicial and prosecutorial officers and court employees serving there are transferred to the Court of First Instance of Lasithi. The regional seats of the Court of First Instance of Lasithi are defined as: a) Sitia, under the territorial jurisdiction of which the Municipality of Sitia falls and b) Ierapetra, under the territorial jurisdiction of which the Municipality of Ierapetra falls.

The organic positions of judges and prosecutors of the Court of First Instance of Lasithi are defined as follows: a) Presidents of First Instances: one (1), b) First Instance Judges: eleven (11), c) Judicial Paredes: zero (0), d) First Instance Prosecutors: one (1) ), e) Deputy Prosecutors of First Instance: one (1), f) Prosecuting Attorneys: one (1). The organic positions of judicial officers of the First Court of Lasithi amount to thirty-four (34).

m) In the Regional Unit of Rethymno (former Prefecture of Rethymno) the Court of First Instance of Rethymno, as the central seat, and the Prosecutor’s Office of First Instance, with headquarters in Rethymno, are maintained. The District of the Court of First Instance of Rethymno includes the Municipalities of the Regional Unit of Rethymno. The Peace Court of Rethymno is abolished. The organizational positions of the judicial and prosecutorial officers and court employees serving there are transferred to the Court of First Instance of Rethymno.

The organic positions of judges and prosecutors of the Court of First Instance of Rethymno are defined as follows: a) Presidents of First Instance: two (2), b) First Instance Judges: eleven (11), c) Judicial Paredes: zero (0), d) First Instance Prosecutors: one (1) ), e) Prosecutors of First Instance: two (2). The organic positions of judicial officers of the Court of First Instance of Rethymno amount to thirty-five (35).

nb) In the Regional Unit of Chania (former Prefecture of Chania), the Court of First Instance of Chania, as the central seat, and the Prosecutor’s Office of First Instance, with headquarters in Chania, are maintained. The District of the Court of First Instance of Chania includes the Municipalities of the Regional Unit of Chania. The Chania and Vamos Magistrates’ Courts are abolished. The organizational positions of the judicial and prosecutorial officers and court employees serving there are transferred to the Court of First Instance of Chania. Vamos is designated as the regional seat of the Court of First Instance of Chania, under whose jurisdiction fall the Municipalities of Apokoron, Sfakion and Gavdos.

The organic positions of judges and prosecutors of the Court of First Instance of Chania are defined as follows: a) Presidents of First Instance: two (2), b) First Instance Judges: twenty two (22), c) Judicial Paredes: two (2), d) First Instance Prosecutors: two ( 2), e) Prosecutors of First Instance: three (3). The organic positions of judicial officers of the Court of First Instance of Chania amount to fifty-nine (59).

2. The seats and regions of the appeals courts are defined as follows:

c) Court of Appeal of Eastern Crete, based in Heraklion. The district of the Court of Appeal of Eastern Crete includes the districts of the Courts of First Instance of Heraklion and Lasithi.

n) Court of Appeal of Crete, based in Chania. The regions of the Courts of First Instance of Chania and Rethymno fall under the jurisdiction of the Court of Appeal of Crete.

The bill is under public consultation until April 18.
