donations… mainly for the State

1.6 million euros collected for the policeman’s family

Launched by Jean Messiha, born Hossam Botros Messiha, figure of the extreme right, former member of the National Front then of the National Rally and finally of Reconquête which he will leave after the failure of Eric Zemmour in the Presidential election of 2022, the kitty did not fail to cause a scandal. In particular because the donations exploded and were far superior to those in favor of the family of the young Nahel.

Closed on July 4, 2023, the pot will have reached the record sum of 1.636 million euros. A sum that the donors no doubt thought to pay to the family of the policeman… in full. However, it is not the case. If the kitty is not canceled by justice, which remains a possibility, the vast majority of this sum will actually end up in the state coffers.

Prize pools are subject to donation tax

The French law on the taxation of donations is clear, recalls Challenges. Sums donated to third parties beyond the 4th degree of kinship or between non-relatives » are subject to a tax of 60% of the total. To put it simply, 60% of the sum will be donated… to the French state. On a donation of 100 euros, for example, it is therefore 60 euros that the donor pays to the State, and 40 euros to the real beneficiary.

This is not the case for donations to associations, for example, which enjoy a separate status. And which, moreover, allow part of the sums to be tax exempt, subject to supporting documents.

As part of the policeman’s kitty, this represents the tidy sum of 938,037 euros. And the GoFundMe platform, on which the kitty was set up, will recover 68,000 euros in costs, since the kitties are not free.

Eventually, the policeman’s family will only receive around 625,000 euros, after having paid almost a million euros in tax. A sum to be paid quickly: the law only provides for a maximum period of 30 days after receipt of the sums to pay the tax.
